Terms of Service

These Terms govern your access to and use of nityatattva.in and any purchase you make from us.

Please read these Terms carefully. By accessing the Site or placing an order, you agree to be bound by them. If you do not agree, do not use the Site.

1. The seller and operator

The Site is operated by Nitya Tattva Consumer Foods LLP, a limited liability partnership incorporated under the Limited Liability Partnership Act, 2008, having its registered office at Pukhraj Residency, Near Mohan Bagh, Alkapuri, Ratlam, 457001, Madhya Pradesh, India (GSTIN: __FILL_IN_GSTIN__; FSSAI: __FILL_IN_FSSAI_LICENCE__). We are an “inventory e-commerce entity” under the Consumer Protection (E-Commerce) Rules, 2020.

2. Eligibility

You must be at least 18 years old and competent to contract under the Indian Contract Act, 1872 to place an order. By creating an account you confirm that the information you provide is accurate and that you are acting on your own behalf.

3. Your account

  • You are responsible for keeping your login credentials confidential.
  • Notify us immediately at hello@nityatattva.in of any unauthorised access.
  • We may suspend or terminate an account that is used for fraud, abuse, repeated chargebacks, or violation of these Terms.

4. Products, descriptions & pricing

4.1 Product information

Product descriptions, origin stories, photographs and editorial facts are provided for information only. Because every harvest is an agricultural product, slight variations in colour, aroma, grain size and weight (within the labelled tolerance) are normal and are not a defect. Nutritional information is based on representative laboratory analysis and may vary by batch.

4.2 Pricing & taxes

  • All prices are in Indian Rupees (₹) and include GST at the applicable rate.
  • A GST-compliant tax invoice is issued with every order and is available from your account dashboard.
  • If a pricing error appears on the Site, we may cancel the order and refund any amount paid before dispatch.

5. Orders & acceptance

Your order is an offer to buy. The contract of sale is formed only when we send you the dispatch confirmation. Until then we may refuse an order — for example, if stock is unavailable, if we suspect fraud, or if a shipping address is outside our serviceable pincodes.

6. Payment

Payments are processed by Razorpay Software Pvt. Ltd. (a PCI-DSS Level 1 certified payment aggregator regulated by the RBI). We do not store full card numbers or banking credentials. Cash on Delivery (where available) becomes payable in Indian Rupees in cash or UPI on receipt of the order.

7. Shipping, delivery & risk of loss

Shipping is governed by our Shipping Policy. Title and risk of loss pass to you when the courier delivers the package to your address or to a person reasonably appearing to receive it on your behalf.

8. Cancellations, returns & refunds

Governed by our Refunds & Cancellations Policy, which is incorporated into these Terms by reference. Because we sell consumable food products, our return rights are narrower than for electronics or apparel — read that policy before placing an order.

9. Food safety & permitted use

  • Our products are food items packaged under FSSAI licence __FILL_IN_FSSAI_LICENCE__.
  • Always check the “best before” date on the pack before consumption.
  • Store as printed on the pack — typically a cool, dry place, away from direct sunlight.
  • If you have a food allergy, read the ingredients list carefully and consult a medical professional before consuming. We disclose all major allergens declared in FSSAI Regulation 2.4.5.
  • The Site is not a substitute for professional medical, nutritional or dietary advice. No statement on the Site is a claim to diagnose, treat, cure or prevent any disease.

10. Promotions, coupons & Tattva Points

  • Coupon codes are valid for the period and conditions stated. We may revoke a coupon if used in violation of its terms or fraudulently.
  • Tattva Points are loyalty credit issued at our discretion at the rate of 5 points per ₹100 spent. 1 point = ₹1 off a future order. Minimum redemption: 50 points.
  • Points expire 6 months after they are earned. Points have no cash value, are non-transferable, and may be cancelled if associated orders are refunded.

11. Reviews & user content

By posting a review you grant us a worldwide, royalty-free, perpetual licence to display, translate and excerpt it on the Site and in marketing materials. You confirm the review is your own opinion, factually accurate, and does not infringe any third party’s rights. We may remove any review that is defamatory, off-topic, or violates Indian law.

12. Intellectual property

The Site, our brand name, logos, packaging design, copy, photographs and product formulations are protected by copyright, trademark and other IP rights owned by Nitya Tattva Consumer Foods LLP or licensed to us. Personal, non-commercial use of the Site is permitted; any other use, including scraping, mirroring or training generative models on our content, requires our prior written consent.

13. Prohibited use

You agree not to:

  • Use the Site for any unlawful, fraudulent or abusive purpose.
  • Probe, scan or test the vulnerability of the Site without our written consent.
  • Interfere with the proper working of the Site or use automated means to access it.
  • Submit content that is obscene, hateful, infringing or otherwise unlawful.
  • Re-sell our products commercially without a separate wholesale agreement with us.

14. Disclaimer & limitation of liability

To the maximum extent permitted by law, the Site and the products are provided on an “as is” basis. We disclaim implied warranties to the extent the Consumer Protection Act, 2019 allows. Our aggregate liability for any claim arising out of or relating to a product or your use of the Site is limited to the amount you paid for the order giving rise to the claim. Nothing in these Terms limits liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under Indian law.

15. Indemnity

You agree to indemnify Nitya Tattva Consumer Foods LLP, its partners, employees and contractors against losses, damages and reasonable legal costs arising from your breach of these Terms or your unlawful use of the Site.

16. Governing law & dispute resolution

These Terms are governed by the laws of the Republic of India. Disputes are subject to the exclusive jurisdiction of the courts at Ratlam, Madhya Pradesh, except that a consumer is free to invoke the relief of the appropriate consumer-redressal forum under the Consumer Protection Act, 2019. Before approaching a court, please write to our Grievance Officer; we are usually able to resolve matters within 30 days.

17. Force majeure

Neither party is liable for any failure or delay caused by events beyond reasonable control — including acts of God, monsoon flooding, courier strike, government restriction or pandemic.

18. Changes to these Terms

We may update these Terms from time to time. The current version always lives at this URL with an updated “Last updated” date. Continued use of the Site after a change means you accept the revised Terms.
